PublishToolkit Terms of Service
Covering PublishScout and PublishDash
Updated 23 October 2026
These Terms of Service should be read together with our Privacy Policy.
1. About Us and Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of PublishScout and PublishDash (together, the “Services”).
The Services are provided by Carrick Investments Pty Ltd ABN 76 644 527 275, trading as PublishToolkit (“PublishToolkit”, “we”, “us” or “our”).
By creating an account, purchasing or commencing a subscription, or otherwise expressly accepting these Terms, you (“you”, “your” or “User”) agree to be bound by them.
If you do not agree to these Terms, you must not use the Services.
Where we require electronic acceptance, you will be asked to take an affirmative step, such as selecting a checkbox stating that you have read and agree to these Terms.
We may retain an electronic record of your acceptance, including your account identifier, the version of the Terms accepted, and the date and time of acceptance.
If you use a Service on behalf of a company, business or other organisation, you represent that you have authority to bind that organisation to these Terms.
2. Description of the Services
2.1 PublishScout
PublishScout generates book concept ideas, market trend signals, keyword and positioning suggestions, outline drafts and related material based on information you provide and third-party sourced or publicly available information.
PublishScout allows you to export certain information and Output generated through your use of the Service.
2.2 PublishDash
PublishDash analyses Amazon Advertising reports and other information that you manually upload and generates prioritised recommendations, such as Stop, Fix, Scale, Watch and Learn recommendations, relating to your advertising campaigns.
PublishDash may retain relevant historical advertising information while your account remains active so that it can provide historical analysis, comparisons and lifetime performance information.
PublishDash is not connected directly to your Amazon Advertising account through an Amazon API and does not make changes to your Amazon Advertising campaigns or account. You decide which reports to upload and whether to implement any recommendation generated by PublishDash.
2.3 Automated and AI-generated functionality
The Services may use automated systems, artificial intelligence, third-party information and third-party technology providers to generate or process results.
Some or all of the Services may from time to time be identified as beta, preview, trial or pre-release services. Such Services may be incomplete and their features, availability and Output logic may change.
3. Beta Services and Transition to Paid Subscriptions
A Service identified as beta, preview, trial or pre-release is under active development and may contain defects, errors or incomplete functionality.
Its features, interfaces, availability, Output methodology and functionality may change as development continues.
We may modify or discontinue beta functionality where reasonably necessary for development, security, legal compliance, technical reasons or operation of the Service.
Where reasonably practicable, we will give reasonable notice of material changes that adversely affect your use of a Service.
Where beta access is provided free of charge, that access does not constitute a paid subscription.
The introduction of paid plans or pricing does not authorise us to begin charging you automatically.
If you wish to continue using a Service under a paid subscription following a free beta period, you will be asked to select a paid plan and accept the applicable price, billing arrangements and then-current Terms before charges commence.
3.1 PublishDash free trial
Unless a different offer is expressly disclosed, eligible new PublishDash members receive a 14-day free trial starting when they first log in. No payment card is required for this trial, and it does not automatically convert to a paid subscription. You must expressly choose a paid plan and complete checkout before subscription charges begin.
When the trial expires without a paid subscription, you may continue to view your existing reports, recommendations, book library and other retained account information, but you cannot upload a new report. This continued access is subject to these Terms, account security requirements and the continued availability of the Service. Existing beta or legacy access arrangements remain as separately communicated; introducing these trial terms does not itself withdraw an existing exemption.
3.2 PublishDash plan limits
PublishDash plans limit the number of active book titles. Different formats of the same title, such as Kindle, paperback and hardcover, count together as one title when correctly grouped in your library. The applicable title limit is displayed before purchase.
If a plan change leaves your account above its active-title limit, you must select which titles remain active before uploading another report. Not making a selection does not provide unlimited access. Inactive titles and their existing historical information are retained under our retention arrangements; deactivation is not account or data deletion.
4. Suggestions Only — Not Professional Advice
Content generated or presented by the Services, including scores, recommendations, checklists, keyword lists, outlines, concept packs, classifications, estimates and other results (“Output”), is provided as a general informational and decision-support tool only.
The Output:
does not constitute financial, investment, legal, tax, accounting, publishing, marketing or other professional advice;
may be generated using automated research, artificial intelligence, third-party information and inference;
may contain errors, omissions, inaccuracies, outdated information or incorrect assessments; and
should not be treated as a substitute for your own judgement or appropriate professional advice.
Any commercial score, confidence level, projection, trend indication or other estimate is an estimate only. It is not a prediction, representation, warranty or guarantee of sales, revenue, advertising performance or any other commercial result.
5. Your Responsibility for Decisions
You remain responsible for evaluating the Output and deciding whether and how to use it.
You are responsible for decisions you make concerning publishing, advertising, marketing, expenditure, bidding, pricing, keywords, targeting or any other activity, whether or not those decisions are informed by Output from the Services.
You should exercise your own judgement and, where appropriate, obtain independent professional advice before acting on Output.
Subject to any rights that cannot lawfully be excluded, we do not guarantee that use of the Services will increase sales or revenue, reduce advertising costs, improve rankings, generate profits or achieve any particular result.
Nothing in these Terms requires you to implement any recommendation generated by a Service.
6. PublishScout — Specific Terms
PublishScout's trend research, commercial scoring, keyword positioning and related Output may be generated from a combination of third-party sourced signals and AI inference.
Where reasonably practicable, Output may distinguish between information classified as “Observed” and information classified as “Inferred”.
We do not guarantee:
the accuracy, completeness or continued availability of any third-party source;
that an inference accurately reflects current or future market conditions; or
that a book or other work developed using a PublishScout concept, outline or recommendation will sell or perform commercially.
Concept packs, outlines, positioning material and other creative Output are intended as starting points for your own work.
You are responsible for reviewing material before publishing, distributing, commercialising or otherwise using it and for considering whether that material infringes copyright, trade marks, privacy, confidentiality or other rights of a third party.
7. PublishDash — Specific Terms
PublishDash generates recommendations from advertising reports and other information that you manually provide.
Its analysis reflects the information available to the Service at the time the Output is generated and may not take account of information or circumstances outside the data provided.
You are responsible for reviewing and deciding whether to implement any recommendation, including recommendations concerning bids, keywords, targets, campaign settings or budgets.
Subject to rights and liabilities that cannot lawfully be excluded, we do not guarantee any particular change in expenditure, sales, profitability, rankings or advertising performance as a result of following or not following a PublishDash recommendation.
You are responsible for:
ensuring that information and reports you provide are sufficiently accurate for your intended analysis;
maintaining your Amazon Advertising account and settings; and
complying with Amazon's applicable terms, policies and requirements.
PublishDash may display historical or “lifetime” results showing advertising performance and changes recorded during the period in which you have used the Service.
Those results provide historical and comparative information. Unless expressly stated otherwise, they do not establish that a change in advertising performance was caused solely by PublishDash or by a particular PublishDash recommendation.
PublishToolkit is independent of Amazon. PublishToolkit and PublishDash are not operated, sponsored or endorsed by Amazon unless expressly stated otherwise.
8. Accounts and Security
You must provide accurate account information and keep it reasonably current.
You are responsible for maintaining the confidentiality and security of your account credentials.
You should notify us promptly at support@publishtoolkit.com if you become aware of unauthorised access to your account.
You must not knowingly permit another person to use your account contrary to applicable subscription or account limits.
We may take reasonable steps to protect the security, integrity and availability of the Services and user accounts.
9. Acceptable Use
You must not use the Services:
unlawfully or fraudulently;
to infringe another person's intellectual property, privacy, confidentiality or other legal rights;
to upload content or data that you do not have authority to provide to us for processing;
to interfere with, damage or compromise the Services or their security;
to introduce malicious code;
to attempt to gain unauthorised access to accounts, systems or data;
to reverse engineer or attempt to extract source code except to the extent such restriction is prohibited by applicable law; or
in any other manner that materially interferes with another user's use of the Services.
We may take proportionate action in response to suspected misuse, including restricting relevant functionality or suspending access where reasonably necessary.
10. User Content and Data
“User Content” means reports, account data, files, prompts, information and other material that you upload, enter or otherwise provide through the Services.
As between you and PublishToolkit, you retain any rights you hold in your User Content.
You grant us a non-exclusive licence to host, copy, transmit, process and otherwise use User Content to the extent reasonably necessary to provide, operate, secure, maintain and improve the Services, comply with law and carry out purposes described in our Privacy Policy.
10.1 PublishScout exports
PublishScout may allow you to download or export User Content and Output associated with your account.
PublishToolkit does not claim ownership of your exported User Content or user-specific Output.
Subject to applicable law and third-party rights, you may use exported Output for your own purposes, including commercial purposes.
10.2 PublishDash historical data
Relevant PublishDash information may be retained while your account remains active where this is necessary to provide historical analysis, comparisons, lifetime performance information and other features of the Service.
11. Artificial Intelligence and Third-Party Processing
PublishScout uses third-party artificial intelligence to generate research, book concepts, assessments and related Output. Information sent for that processing can include the topics, concept details, reader descriptions, notes, feedback and other content relevant to your request.
PublishDash generates advertising recommendations using calculation rules. This does not mean that information stored on the application platform is excluded from the platform provider’s processing arrangements.
PublishToolkit does not use your User Content or Output to train its own proprietary artificial intelligence models. However, we do not promise that all third-party providers are prohibited from using information for AI development, training or improvement.
Base44 states that workspace data may be used for AI training on plans other than Enterprise and that Enterprise workspaces have an automatic training exclusion. Base44’s Data Processing Addendum separately addresses and restricts the processing of personal information. The applicable plan, contractual arrangements and type of information determine permitted uses. Further details are provided in our Privacy Policy.
Only submit information you are authorised to provide. Avoid unnecessary sensitive personal information or confidential information about other people. Nothing in this clause gives us or a provider permission to process information contrary to applicable law or an applicable data-processing obligation.
12. Privacy
Our Privacy Policy explains the personal information we collect, why we use it, the providers involved, overseas processing, retention, deletion, access and correction, and how to make a privacy complaint. You can request a copy by emailing support@publishtoolkit.com.
We use Base44 to provide the application platform, account authentication, database, file storage and related services. We use Stripe for payments when you select paid features. PublishScout also uses AI processing and marketplace-research providers. Relevant information may be processed outside Australia, including in the United States and other countries identified in our Privacy Policy.
New original reports uploaded through PublishDash use private storage. A report owner or administrator can request a temporary download link, which may be used by anyone holding it while it remains valid. Some older originals were stored at public URLs and may remain accessible until the stored files and cached copies are removed. Replacing a report or deleting its app record does not itself revoke those public links. Our Privacy Policy explains the current arrangements and the work to address older files.
Your acceptance of these Terms does not replace any specific consent required by privacy or marketing law, waive your statutory privacy rights, or authorise unrelated marketing. If separate consent is required for a particular use, we will request it separately.
13. Data Retention and Account Deletion
We retain relevant account information and User Content for the purposes described in our Privacy Policy, including saved research and PublishDash historical analysis while you keep an account. Trial expiry, subscription cancellation and book deactivation do not automatically delete your account or retained information.
Subscription cancellation and account deletion are separate actions. You can cancel future subscription renewals through the billing controls. To request account and data deletion, email support@publishtoolkit.com from your registered email address. We may reasonably verify your identity before acting.
We will assess your request and delete or de-identify information we are able and required to remove within the period required by applicable law, or otherwise within a reasonable period. We will explain any relevant limitations or information that must be retained. If you have a paid subscription, we will also confirm the arrangements for ending it so recurring charges do not continue unintentionally.
Account profiles, database records, original uploaded files, logs and backups must be considered separately. Deleting a profile or report record does not itself erase every associated file or provider-held copy. Some removal steps may require assistance from a service provider. We do not promise immediate erasure of every copy.
Information may be retained where reasonably necessary for legal, accounting or tax obligations, security, fraud prevention, dispute resolution or enforcing legal rights. Residual copies may remain in backups until overwritten or deleted under the relevant provider’s procedures. Payment providers may independently retain information they are required to keep.
We do not guarantee indefinite storage. Any material retention limits and notice arrangements will be explained in the Privacy Policy, subject to applicable law. Nothing in these Terms limits a deletion, access, correction or other privacy right that cannot lawfully be excluded.
14. Intellectual Property and Output
PublishToolkit and its licensors retain their rights in the Services, including the underlying software, interfaces, methodology, branding, documentation, site content and other technology.
As between you and PublishToolkit, you retain any intellectual property rights you hold in User Content.
PublishToolkit does not claim ownership of Output generated specifically for you through your use of the Services.
Subject to applicable law, our rights in the Services and third-party rights, you may download, export, publish, modify and commercially use your Output.
However, because Output may be generated using artificial intelligence or automated systems:
Output may not be unique;
other users may receive identical or similar material;
particular Output may not qualify for copyright or other intellectual property protection; and
we do not guarantee that Output is free from third-party rights.
You are responsible for reviewing Output before publishing, commercialising or otherwise using it.
15. Third-Party Services
The Services may depend upon or interact with third-party platforms, data sources, hosting services, artificial intelligence providers, payment providers and other technology services.
We do not control third-party services and cannot guarantee their continued availability, functionality or accuracy.
A third-party provider may change, restrict or discontinue its services or access arrangements. Where this materially affects PublishToolkit, we may need to modify affected functionality.
Your use of a third-party service may also be subject to that third party's applicable terms and privacy practices.
16. Fees and Subscriptions
Paid subscriptions are offered in United States dollars (USD).
We may offer monthly and annual subscription plans.
The applicable price, billing period, included features and any applicable taxes or charges will be clearly disclosed before you purchase a subscription.
Unless expressly stated otherwise, subscription fees are charged in advance for the applicable monthly or annual billing period.
Automatic renewal
Paid subscriptions automatically renew at the end of each billing period unless cancelled before the applicable renewal date.
By purchasing an automatically renewing subscription, you authorise us and our payment processor to charge the applicable subscription fee using your selected payment method at each renewal until you cancel.
Before you purchase, we will clearly identify:
the amount payable;
whether the subscription is monthly or annual;
that the subscription automatically renews;
the applicable renewal frequency; and
how the subscription can be cancelled.
Payment processing
Payments are processed by Stripe or another payment provider identified at checkout.
PublishToolkit does not need to receive or store your complete payment-card details where those details are collected and processed directly by our payment provider.
Failed payments
If a payment fails, we or our payment provider may attempt to process the payment again and may ask you to update your payment information.
We may suspend access to paid functionality if subscription fees remain unpaid after a reasonable opportunity to resolve the failed payment.
16.1 PublishDash plan changes
PublishDash paid plans, when enabled, are billed monthly. Annual plans are not offered unless expressly made available at checkout. An upgrade normally takes effect immediately, with prorated charges or credits for the remaining billing period. Any immediate amount payable will be shown before confirmation. A downgrade normally takes effect at the end of the current paid billing period. Your current plan limits continue until the downgrade takes effect.
16.2 PublishDash foundation membership
The PublishDash foundation offer is limited to the first 50 qualifying paid subscribers whose foundation discount is successfully applied at checkout. The offer gives 50% off the standard subscription price of the eligible PublishDash plan, rather than fixing the subscription to a particular dollar price. Eligibility and the discounted amount are displayed before purchase. The offer applies to the Starter, Author, Pro Author and Publisher plans and does not automatically include PublishScout, other products or future plans.
For this offer, “lifetime” means the duration of your continuous eligible paid PublishDash subscription while the Service is offered. The discount remains when you change between eligible plans, including upgrades and downgrades. It does not mean a lifetime guarantee that the Service or its standard prices will remain unchanged.
If you schedule cancellation at the end of a billing period, the discount remains until the subscription actually ends. Withdrawing that cancellation before the subscription ends preserves the discount. Once the subscription terminates, including following unresolved non-payment, foundation eligibility ends and does not automatically return on resubscription. An administrator may expressly restore the discount, for example to correct an error. Restoration is not an automatic entitlement.
16.3 PublishDash payment grace period
For a failed subscription renewal payment, PublishDash ordinarily provides a seven-day grace period measured from the renewal invoice’s creation time. Repeated payment attempts do not restart that period. During the grace period, paid access continues while you resolve payment. If payment remains unresolved when the grace period ends, new report uploads are blocked; existing account information remains available under the access and retention arrangements described in these Terms. Successful payment restores access subject to your plan limits. Stripe may separately retry collection or terminate an unpaid subscription under the billing arrangements disclosed to you.
17. Cancellation, Renewal and Refunds
You may cancel a paid subscription at any time using the online cancellation facility available through your account or another cancellation method we make available.
Cancellation stops the subscription from renewing for a further billing period.
Unless otherwise stated at the time of purchase, cancellation takes effect at the end of the billing period you have already paid for, and you may continue using the applicable paid Service until that time.
Cancelling your subscription does not automatically delete your account or User Content.
If you wish to delete your account and associated User Content, contact us as described in clause 13.
Except where required by applicable law or expressly stated otherwise, we do not provide refunds or credits merely because you change your mind or cancel part-way through a billing period.
Nothing in this clause excludes or restricts any refund, remedy, cancellation right or other protection that cannot lawfully be excluded under the Australian Consumer Law or another applicable law.
Annual renewals
We may send a reminder before an annual subscription renews.
Price changes
We may change subscription prices from time to time.
We will provide reasonable advance notice of a material increase to the price of an existing recurring subscription.
A price increase will apply prospectively from a subsequent renewal and will not retrospectively change fees already paid.
If you do not wish to continue at the new price, you may cancel before the applicable renewal.
18. Australian Consumer Law and Liability
18.1 Non-excludable rights
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or other protection conferred by the Australian Consumer Law in Schedule 2 to the Competition and Consumer Act 2010 (Cth) or any other applicable law where doing so would be unlawful.
18.2 Exclusion of liability where permitted
Subject to clause 18.1 and to the maximum extent permitted by applicable law, we exclude liability for indirect, incidental, special or consequential loss arising out of or in connection with the Services or Output, including loss of profits, revenue, anticipated savings, business opportunities or goodwill.
This clause does not exclude liability to the extent that it cannot lawfully be excluded.
18.3 Limitation where permitted by law
Where applicable law permits liability for a failure to comply with a statutory guarantee relating to services to be limited, our liability is limited, at our option and to the extent permitted by law, to:
(a) supplying the relevant services again; or (b) paying the cost of having the relevant services supplied again.
18.4 Aggregate liability cap
Subject to clauses 18.1 and 18.5, and only to the extent permitted by applicable law, our total aggregate liability arising out of or in connection with the affected Service or these Terms is limited to the subscription fees you paid for the affected Service during the 12 months immediately before the event giving rise to the claim. Fees paid outside that 12-month period are excluded. This is an aggregate limit for the claims to which it applies, not a separate limit for each claim.
18.5 Exceptions to the exclusions and limits
The exclusions and limits in clauses 18.2 to 18.4 do not apply to our fraud or wilful misconduct, our breach of confidentiality or privacy obligations, death or personal injury caused by our negligence, or any liability, consumer guarantee, right or remedy that cannot lawfully be excluded or limited. These clauses do not prevent you from exercising any mandatory refund, compensation or other remedy available under applicable law.
19. Suspension and Termination
Termination by you
You may stop using a free Service at any time.
You may cancel a paid subscription in accordance with clause 17.
You may separately request deletion of your account in accordance with clause 13.
Suspension or termination by us
We may suspend or terminate access where reasonably necessary because:
you materially breach these Terms and, where the breach is capable of remedy, fail to remedy it within a reasonable period after notice;
fees properly due remain unpaid;
your use creates a material security, legal or operational risk;
we reasonably believe your account is being used unlawfully or fraudulently;
suspension or termination is reasonably necessary to protect users, third parties or the Services;
we are required to do so by law; or
we discontinue the relevant Service.
Where reasonably practicable, we will provide notice before suspension or termination.
If we discontinue a paid Service for reasons unrelated to your breach, we will provide any refund, credit or other remedy required by applicable law and may provide a proportionate refund or credit for any prepaid period during which the Service is no longer available.
Following termination, provisions that by their nature are intended to survive termination continue to apply.
20. Changes to the Services and These Terms
We may update these Terms where reasonably necessary, including to reflect changes to the Services, applicable law, security requirements or our business operations.
We may make minor or administrative changes without advance notice.
If we make a material change that adversely affects users' contractual rights or obligations, we will take reasonable steps to provide advance notice before the change takes effect.
Changes apply prospectively from their stated effective date.
Where a material change substantially disadvantages a user of a paid subscription, any cancellation, refund or other rights required by applicable law will continue to apply.
Where we require you to enter a materially different commercial arrangement, including electing to move from free beta access to a paid subscription, we may require fresh affirmative acceptance of the then-current Terms.
21. Service Availability
We aim to provide reliable access to the Services but do not guarantee that they will always be uninterrupted or error-free.
The Services may occasionally be unavailable because of maintenance, updates, technical problems, security events, third-party outages or circumstances outside our reasonable control.
Nothing in this clause limits rights that cannot lawfully be excluded.
22. Governing Law and International Users
These Terms are governed by the laws of Queensland, Australia.
You and Carrick Investments Pty Ltd submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from them.
PublishToolkit is based in Australia and may provide Services to users in Australia and other countries, including the United States, United Kingdom and New Zealand.
If the law of the country, state or territory in which you reside gives you mandatory consumer, privacy, subscription or other legal rights that cannot lawfully be excluded by agreement, nothing in these Terms is intended to exclude, restrict or modify those rights.
Users outside Australia are responsible for complying with laws applicable to their own use of the Services, except to the extent responsibility cannot lawfully be imposed on the user.
23. General
If a provision of these Terms is invalid or unenforceable, it will be read down to the extent necessary and legally possible. If it cannot be read down, that provision may be severed without affecting the remaining provisions.
A failure or delay in exercising a contractual right does not by itself constitute a waiver of that right.
You may not assign your rights or obligations under these Terms without our prior consent, except where applicable law provides otherwise.
We may assign or transfer our rights or obligations where reasonably necessary as part of a corporate restructure, sale or transfer of the business or relevant assets, provided this does not materially reduce your rights under these Terms.
These Terms, together with any additional terms expressly presented and accepted in connection with a particular subscription or Service, constitute the agreement concerning your use of the Services, subject always to rights that cannot lawfully be excluded.
24. Contact and Complaints
Questions, complaints or notices concerning these Terms or the Services may be sent to:
Carrick Investments Pty Ltd trading as PublishToolkit ABN: 76 644 527 275 Email: support@publishtoolkit.com Address: 1/1-15 Geraldton Drive, Robina QLD 4226, Australia
